These Regulations amend the Landfill (England and Wales) Regulations 2002 for the purpose of implementing Council Decision 2003/33/EC establishing criteria and procedures for the acceptance of waste at landfills pursuant to Article 16 of and Annex II to Directive 1999/31/EC. They also make provision in respect of the implementation of the Landfill Directive.

The regulations set out a pollution control regime for landfills including the conditions to be included in landfill permits. It also requires the Environment Agency to classify landfills as hazardous waste, non-hazardous waste or inert waste.
